{"id":668,"date":"2025-10-27T11:19:30","date_gmt":"2025-10-27T11:19:30","guid":{"rendered":"https:\/\/agrupacionespsoe.es\/barbate\/?p=668"},"modified":"2025-10-27T11:19:31","modified_gmt":"2025-10-27T11:19:31","slug":"el-consejo-de-transparencia-de-andalucia-confirma-que-el-ayuntamiento-de-barbate-vulnera-el-derecho-a-la-informacion","status":"publish","type":"post","link":"https:\/\/agrupacionespsoe.es\/barbate\/el-consejo-de-transparencia-de-andalucia-confirma-que-el-ayuntamiento-de-barbate-vulnera-el-derecho-a-la-informacion\/","title":{"rendered":"El Consejo de Transparencia de Andaluc\u00eda confirma que el Ayuntamiento de Barbate vulnera el derecho a la informaci\u00f3n"},"content":{"rendered":"\n<p><em>El PSOE de Barbate denuncia la opacidad del gobierno local del PP y AxS\u00ed y se pregunta qu\u00e9 pretende ocultar al vulnerar el derecho de acceso a la informaci\u00f3n p\u00fablica con asuntos como el gasto en dietas de los concejales, el Cine Avenida o la deuda municipal<\/em><em><\/em><\/p>\n\n\n\n<p><strong>Barbate, 27 de agosto de 2025 \u2013<\/strong>&nbsp;El PSOE de Barbate ha hecho p\u00fablico el oficio emitido por el&nbsp;<strong>Consejo de Transparencia y Protecci\u00f3n de Datos de Andaluc\u00eda<\/strong>, que confirma la denuncia presentada por el grupo municipal socialista en&nbsp;<strong>octubre de 2024<\/strong>&nbsp;contra el equipo de gobierno formado por&nbsp;<strong>Andaluc\u00eda Por S\u00ed (AxS\u00ed)<\/strong>&nbsp;y el&nbsp;<strong>Partido Popular (PP)<\/strong>, por vulnerar el&nbsp;<strong>derecho de acceso a la informaci\u00f3n p\u00fablica<\/strong>.<\/p>\n\n\n\n<p>La denuncia se fundamenta en la negativa reiterada del Ayuntamiento a facilitar m\u00e1s de&nbsp;<strong>un centenar de expedientes solicitados<\/strong>&nbsp;por el grupo socialista, a pesar de que este derecho est\u00e1 amparado por la&nbsp;<strong>Constituci\u00f3n Espa\u00f1ola<\/strong>, el&nbsp;<strong>Reglamento de Organizaci\u00f3n, Funcionamiento y R\u00e9gimen Jur\u00eddico de las Entidades Locales (ROF)<\/strong>&nbsp;y otras leyes de rango superior.<\/p>\n\n\n\n<p>Antes de acudir al Consejo de Transparencia, el PSOE de Barbate&nbsp;<strong>requiri\u00f3 en tres y hasta cuatro ocasiones<\/strong>&nbsp;al equipo de gobierno para que cumpliera con sus obligaciones legales. \u201cNo se trata de un simple retraso administrativo, sino de un incumplimiento grave que atenta contra la transparencia y el control democr\u00e1tico\u201d, se\u00f1alan los socialistas, recordando que&nbsp;<strong>en otros municipios de la provincia de C\u00e1diz<\/strong>&nbsp;ya se han producido&nbsp;<strong>inhabilitaciones judiciales<\/strong>&nbsp;a cargos p\u00fablicos por hechos similares.<\/p>\n\n\n\n<p>Entre la documentaci\u00f3n solicitada se incluye informaci\u00f3n relativa al&nbsp;<strong>Cine Avenida<\/strong>, las&nbsp;<strong>piscinas municipales<\/strong>, la&nbsp;<strong>deuda del Ayuntamiento<\/strong>, los&nbsp;<strong>gastos de dietas y kilometraje<\/strong>&nbsp;de concejales y cargos de confianza, as\u00ed como los datos sobre la&nbsp;<strong>comisi\u00f3n de seguimiento con Aqualia<\/strong>. El PSOE se pregunta \u201c<strong>qu\u00e9 tiene que esconder el gobierno local<\/strong>&nbsp;para negarse sistem\u00e1ticamente a facilitar informaci\u00f3n p\u00fablica que la ley obliga a entregar\u201d.<\/p>\n\n\n\n<p>El&nbsp;<strong>derecho de acceso a la informaci\u00f3n p\u00fablica<\/strong>&nbsp;es una herramienta esencial para garantizar la&nbsp;<strong>participaci\u00f3n pol\u00edtica y la fiscalizaci\u00f3n del gobierno<\/strong>, tal y como recoge el&nbsp;<strong>art\u00edculo 23 de la Constituci\u00f3n Espa\u00f1ola<\/strong>. Sin embargo, el actual equipo de gobierno mantiene&nbsp;<strong>documentaci\u00f3n pendiente de entrega desde hace m\u00e1s de un a\u00f1o<\/strong>, haciendo caso omiso a los reiterados avisos del grupo socialista y del propio Consejo de Transparencia.<\/p>\n\n\n\n<p>Desde el PSOE lamentan haber tenido que recurrir a este \u00f3rgano auton\u00f3mico \u201c<strong>para obtener la protecci\u00f3n jur\u00eddica que el propio Ayuntamiento deber\u00eda garantizar<\/strong>\u201d. Adem\u00e1s, advierten de que la resoluci\u00f3n del Consejo conlleva una&nbsp;<strong>advertencia formal al Consistorio<\/strong>&nbsp;y podr\u00eda derivar en una&nbsp;<strong>sanci\u00f3n administrativa<\/strong>&nbsp;por vulnerar la normativa de transparencia.<\/p>\n\n\n\n<p>Por \u00faltimo, el PSOE de Barbate ha anunciado que&nbsp;<strong>presentar\u00e1 una denuncia ante los tribunales<\/strong>&nbsp;por la acumulaci\u00f3n de expedientes sin respuesta \u2014m\u00e1s de treinta en los \u00faltimos meses\u2014, con la \u00fanica excepci\u00f3n del relativo
